29 CFR 1910.212(a)(1):Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. On or about October 3, 2023, the employer failed to ensure employees operating an Altendorf Model F45 sliding table saw were protected from the point of operation (saw blade) by effective machine guarding that maintained the saw blade guard hood in contact with or is less than a 1/4 inch from the material while operating the saw.

29 CFR 1904.39(a)(2):Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. On or about October 19, 2023, the employer did not report within 24 hours the amputation injury of an employee who received a fingertip amputation injury to his right index finger and laceration injuries to his other three right fingers while operating a table saw machine at his workplace on or about October 3, 2023. The employer was notified the injury resulted in a partial amputation of a finger on or about October 18, 2023, and OSHA was not notified of the amputation injury until on or about October 24, 2023, via the OSHA online injury reporting webpage.
