29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  On or about October 30, 2023 the employer JM Quality Construction LLC at jobsite located at 3639 E. Bayshore Rd. Lakeside-Marblehead OH 43440, did not ensure that each affected employee used appropriate eye or face protection when performing residential framing work on a new residential structure while exposed to potential struck by hazards (flying particles/debris) while using a Paslode brand (Model F350S) pneumatic nail gun.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about October 30, 2023, the employer JM Quality Construction LLC at jobsite located at 3639 E. Bayshore Rd. Lakeside-Marblehead OH 43440, did not ensure the side rails of one portable Louisville ladder brand 16-Foot Fiberglass Multi-Section Extension Ladder was extended at least three feet above the landing surface. Five employees were exposed to falls from approximately 11 feet or greater from the top of the second (roof) level to the decking below while using the ladder to access the second (roof) level to perform residential construction framing activities.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   Instance A) On or about October 30, 2023 the employer JM Quality Construction LLC at jobsite located at 3639 E. Bayshore Rd. Lakeside-Marblehead OH 43440, did not ensure employees were protected from falls while conducting residential framing construction activities on the second (roof) level of a new build residential home. Employees were exposed to a falls of 11 feet and 4 tenths or greater to the ground below from the roof eaves level to the ground below, and 18 feet and 6 tenths from the roof peak to the ground below. Employees were working atop a roof with an 8:12 pitch.  Instance B) On or about October 30, 2023 the employer JM Quality Construction LLC at jobsite located at 3690 E. Bayshore Rd. Lakeside-Marblehead OH 43440, did not ensure employees were protected from falls while conducting residential framing construction activities on the second (roof) level of a new build residential home. Employees were exposed to a falls of 11 feet and 4 tenths or greater to the ground below from the roof eaves level to the ground below, and 18 feet and 6 tenths from the roof peak to the ground below. Employees were working atop a roof with an 8:12 pitch.
