29 CFR  1926.102(a)(1): Employees did not use eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  a) Lots 38 & 39 Mill Creek Springs subdivision, Buford, Georgia: On or about 10/31/2023, the employer exposed employees to struck-by  hazards while operating framing nail guns, in that protective eyewear was not provided during framing operations operating these tools at 120 PSI.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) Second floor, top plate, Lot 38: On or about 10/31/2023, the employer exposed employees to fall hazards of approximately 19-feet to the lower ground level, in that a fall protection system was not used while installing roof trusses.   b) Second floor, top plate, Lot 39: On or about 10/31/2023, the employer exposed employees to fall hazards of approximately 19-feet to the lower level, in that the workers were not provided with a fall protection system while engaged in framing activities.     c.) Stairway, Lot 39:  On or about 10/31/2023, the employer exposed employees to fall hazards of approximately 7-foot, 6-inches to the concrete slab below, in that guardrails or other fall protection was not provided while engaged in framing activities.

29 CFR  1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail and one stair rail system along each unprotected side or edge:   a.) Staircase, Lot 39: On or about 10/31/2023, the employer exposed employees to fall hazards of approximately 11-feet to the concrete lower level, in that employees working from the stairway or using the stairway were not provided with stair rails.   b.) Staircase, Lot 38: On or about 10/31/2023,the employer exposed employees to fall hazards of approximately 11-feet to the concrete lower level, in that employees working from the stairway or using the stairway were not provided with stair rails.
