29 CFR 1910.37(a)(3): Exit Routes & Emergency Planning: Exit routes must be free and unobstructed. No materials or equipment may be placed, either permanently or temporarily, within the exit route. The exit access must not go through a room that can be locked, such as a bathroom, to reach an exit or exit discharge, nor may it lead into a dead-end corridor. Stairs or a ramp must be provided where the exit route is not substantially level. 1470 Pleasant Valley Road: On or about November 02, 2023, Employer failed to prevent Employees from accidental injury insuring that exit routes were free and unobstructed. Materials and/or equipment provided by Employer were placed permanently and/or temporarily, within exit routes. A) Sales Floor: Boxes of consumer products blocked aisles and pathways from safe Employee and customer traffic. One of two fire exit hallways-fire exit doors were blocked with custodial material & equipment. B) Stock Room: Designated clear spaces and exit routes were blocked with multi-tiered pallets of consumer products preventing free movement through the area to egress points. C) Loading-Unloading Dock: A designated clear area used for shipping-receiving area, was used as consumer goods and material storage for Employer and adjacent retailer, which blocked all the designated exit routes through the area to the outside of the building.

Bags, containers, bundles, etc., stored in tiers shall be stacked, blocked, interlocked and limited in height so that they are stable and secure against sliding or collapse. 1470 Pleasant Valley Road: On or about November 02, 2023, Employer failed to prevent Employees from accidental injury because stored materials, created a hazard. Bags, containers, bundles, and other organizational storage items were not stacked, blocked, interlocked or limited in height so that they were stable and secure against sliding or collapsing.
