29 CFR 1910.28(b)(1)(i):  Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  a. Foster Logistics, LLC - Lima, Ohio: On or about January 10, 2024, the employer did not ensure employees who accessed the elevated work platform, located in the 500 room, were protected from fall hazards.  Employees were exposed to a fall hazard of approximately 93 inches when working to empty bags of product into the sifting hopper.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.28(b)(3)(i):  The employer did not ensure that each employee is protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the following methods listed in 29 CFR 1910.28(b)(3)(i)(A)-(D):  a. Foster Logistics, LLC - Lima, Ohio: On or about January 10, 2024, the employer did not ensure employees were protected from tripping or stepping into the floor hole(s) adjacent to the hoppers located on the elevated work platform in the 500 room. Employees were exposed to trip/fall and laceration injuries when working to empty bags of product into the hoppers.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. Foster Logistics, LLC - Lima, Ohio: On or about November 2, 2023, the required workplace hazard assessment did not include a documented hazard assessment with written certification that identified the person certifying the workplace evaluation and the date of the hazard assessment.  Employees who filled totes and bags with chemicals were exposed to eye injury, burns to the skin, and respiratory irritation.  No additional abatement information is needed for this item.

29 CFR  1910.178(a)(4):Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:  a. Foster Logistics, LLC - Lima, Ohio: On or about September 29, 2023, the employer did not obtain approval from the forklift manufacturer before adding a single carton clamp attachment and two lifting/spreader bars for use to Nissan forklift #113 (model CPJ02-A25PV). Employees who used the forklift with the carton clamp attachment and added lifting bars to transport bulk bags were exposed to tip-over hazards in that modifications and additions affect the safe operation of the truck.  b. Foster Logistics, LLC - Lima, Ohio: On or about January 10, 2024, the employer did not obtain approval from the forklift manufacturer before adding a bulk bag lifting attachment (device s/n 01889670) on a Nissan forklift (model CPJ02-A25PV) used for 500 room filling operations.  Employees who used the forklift with lifting attachment to transport bulk bags were exposed to tip-over hazards in that modifications and additions affect the safe operation of the truck.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. Foster Logistics, LLC - Lima, Ohio: On or about September 29, 2023, the employer did not ensure that the Nissan forklift #113 (model CPJ02-A25PV) used in the 500 room to lift and transport bulk bags, was marked to identify the single carton clamp and the front-end lifting/spreader bar attachments showing the capacity and approximately weight of the truck and attachment combination at maximum elevation with load laterally centered.  A potential for the forklift to be tipped over as a result of being overloaded exposed employees to crushing hazards.    b. Foster Logistics, LLC - Lima, Ohio: On or about January 10, 2024, the employer did not ensure that the Nissan forklift (model CPJ02-A25PV) used in the 500 room to lift and transport bulk bags, was marked to identify the bulk bag lifting attachment (device s/n 01889670) showing the capacity and approximately weight of the truck and attachment combination at maximum elevation with load laterally centered. Foster Logistics, LLC - Lima, Ohio: On or about October 31, 2023, a flexible extension cord used to power a weigh scale, located in the liquid fill room, was used as a substitute for fixed wiring.  Employees were exposed to electrical hazards in that the temporary wiring/flexible cord was used in lieu of fixed wiring to power the Rice Lake (model 480Plus-2A) scale.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
