29 CFR 1910.134(c)(1):A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: Foster Logistics, LLC, located at 1000 East Hanthorn Road in Lima, Ohio; On or about January 10, 2024, the employer did not establish and implement a written respiratory protection program with worksite specific procedures outlining (1) the selection of respirators for use, (2) medical evaluations of employees, (3) fit testing procedures, (4) cleaning, disinfecting, storing, inspecting, repairing, discarding, and otherwise maintaining respirators, (5) Training of employees in the respiratory hazards to which they are potentially exposed, (6) Training of employees in the proper use of respirators, including putting on and removing them, any limitations on their use, and their maintenance, and (7) procedures for regularly evaluating the effectiveness of the program. Employees handling dry chemicals such as, but not limited to, ethylenediaminetetraacetic acid, glutamic acid, and diethylenetriaminepentaacetic acid in room 23 (dry fill) and room 500 (repack), and liquid fill room were exposed to hazards including, skin and eye irritation, and damage to organs and the respiratory tract.

Employees were exposed to hazards associated with wearing a tight-fitting respirator such as, but not limited to, aggravation of pulmonary issues, such as asthma, emphysema, and aggravate claustrophobia, all contributing to negative health effects.

Employees handling dry chemicals such as, but not limited to, ethylenediaminetetraacetic acid, glutamic acid, and diethylenetriaminepentaacetic acid in room 23 (dry fill) and room 500 (repack), and liquid fill room were exposed to hazards including, skin and eye irritation, and damage to organs and the respiratory tract in that an employee was observed with facial hair that would prevent a facepiece to face seal.
