OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards from automotive lifts: A.) Gerry Raymond Chrysler Dodge Jeep Ram of Brookville, on or about November 11, 2023 and times prior thereto: employees were potentially exposed to struck-by hazards while working under and/or near potentially defective automotive lifts due to the lack of an automotive lift inspection program. Procedures were not established to conduct daily and routine inspections the automotive lifts in order to identify defects associated with the working operation of the lifts. Routine inspections of components such as, but not limited to, the structural components, electrical components and wiring, lift controls, including operation of the positive stop, and the lift locks for the automotive lifts were not conducted. B) Gerry Raymond Chrysler Dodge Jeep Ram of Brookville, on or about November 11, 2023 and times prior thereto: employees were potentially exposed to struck-by hazards while using Eagle auto lift 6. A vehicle tilted on the auto lift because the correct lifting pad was not used for vehicles with undercoated surfaces. Employees were not inspecting cars for undercoating, which would affect the ability of the car to be properly lifted, which would result in cars falling off lifts, and causing injury.
