29 CFR  1926.503(a)(2)(iii):The employer did not assure that each employee has been trained, as necessary, by a competent person in the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used.  On or about November 7, 2023, employees were not trained on the safe use and operation of personal fall arrest systems. This exposed employees to a fall hazard greater than six (6) feet to the ground below.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  On or about November 7, 2023, employees used a ladder to access the roof of a building and the ladder side rails did not extend at least three (3) feet above the landing surface. This exposed the employees to a fall hazard.

29 CFR  1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.  On or about November 7, 2023, employees were performing roofing work activities on the roof of a commercial building and were not in use of fall protection. This exposed the employees to fall hazards greater than six (6) feet to the ground below.  Jose's Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(1), which was contained in OSHA inspection number 1437167, citation number 1, item number 1 and was affirmed as a final order on March 5, 2020, with respect to a workplace located at 6724 N Martin Luther King Ave, Oklahoma City, OK 73111.
