29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. Located at Lot 63, 5922 Damsel Drive, Columbus, Ohio 43232: On or about November 09, 2023, the employer failed to ensure the employee was protected from falling while installing second floor support beams on a new build residential home. 29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. Located at Lot 63, 5922 Damsel Drive, Columbus, Ohio 43232: On or about November 09, 2023, the employer failed to initiate and maintain safety and health programs which included work rules, training, a system for detecting hazards and prompt correction of hazards while employees were performing framing work on a single family home. As a result employees were exposed to falls up to 9 feet and struck-by hazards from improper use of a ladder, no fall protection and no PPE provided/utilized.  Saunders Construction LLC was previously cited under the name TC Saunders Construction LLC for an other-than-serious violation of this Occupational Safety and Health standard 29 CFR  1926.20(b)(1), which was contained in OSHA inspection number 1364051, citation number 3, item number 1 and was affirmed as a final order on January 29, 2019, with respect to a workplace located at 7036 Cannon Drive, Canal Winchester, Ohio 43110.

29 CFR  1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a. Located at Lot 63, 5922 Damsel Drive, Columbus, Ohio 43232: On or about November 09, 2023, the employer failed to provide the employees with any type of fall protection training program for the recognition of fall hazards and procedures to be followed to minimize these hazards, thereby exposing employees to fall hazards of up to 9 feet to the ground below.  Saunders Construction LLC was previously cited under the name TC Saunders Construction LLC for a violation of this Occupational Safety and Health standard 29 CFR  1926.503(a)(1), which was contained in OSHA inspection number 1476952, citation number 1, item number 2 and was affirmed as a final order on August 5, 2020, with respect to a workplace located at 388 Faulkner Drive in Lithopolis, Ohio 43136.

29 CFR  1926.1053(b)(4): Ladders shall be used only for the purpose for which they were designed.   a. Located at Lot 63, 5922 Damsel Drive, Columbus, Ohio 43232: On or about November 09, 2023, the employer did not ensure employees used ladders for the purpose in which they were designed. The employee was working on a 6 foot A frame step ladder. The employee was observed straddling with one foot over the top of the ladder and placed on a rear horizontal support brackets of this ladder, thereby exposing the employee to a fall hazard of approximately 5 feet.  Saunders Construction LLC was previously cited under the name TC Saunders Construction LLC for a violation of this Occupational Safety and Health standard 29 CFR  1926.1053(b)(4), which was contained in OSHA inspection number 1364051, citation number 1, item number 1b and was affirmed as a final order on January 29, 2019, with respect to a workplace located at 7036 Cannon Drive, Canal Winchester, Ohio 43110.
