29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a) Located at 6546 Pfeifer Ash Drive, Canal Winchester, OH 43110: On or about December 6, 2024, the employer did not ensure that employees setting trusses from the second story walls were protected from falling by a fall protection system. As a result, employees were exposed to a fall hazard of greater than 16 feet while performing residential construction.  Saunders Construction LLC was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1709514, citation number 2, item number 1 and was affirmed as a final order on February 27, 2024, with respect to a workplace located at 5922 Damsel Drive Lot 63 Columbus, OH 43232.  Saunders Constuction LLC was previously cited under the name TC Saunders Construction LLC for a violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1418185, citation number 1, item number 1 and was affirmed as a final order on October 2, 2019, with respect to a workplace located at 197 England Street, Pickerington, OH 43147.  Saunders Constuction LLC was previously cited under the name TC Saunders Construction LLC for a violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1364051, citation number 2, item number 1 and was affirmed as a final order on January 29, 2019, with respect to a workplace located at 7036 Cannon Drive, Canal Winchester, OH 43110.  Saunders Constuction LLC was previously cited under the name TC Saunders Construction LLC for a violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1323084, citation number 2, item number 1 and was affirmed as a final order on August 27, 2018, with respect to a workplace located at Lot 5, Pataskala, OH 43062.  Saunders Constuction LLC was previously cited under the name TC Saunders Construction LLC for a violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1289775, citation number 1, item number 2 and was affirmed as a final order on February 21, 2018, with respect to a workplace located at 662 Raab Street, Pickerington, OH 43147.

29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a) Located at 6546 Pfeifer Ash Drive, Canal Winchester, OH 43110: On or about December 6, 2024, the employer did not ensure the ladder's side rails extended 3 feet for employees who accessed the second level of the residential home. Employees utilized an 8 foot A-Frame ladder that did not reach the second level, exposing employees to a fall height of more than 8 feet.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder shall not be used as a step.  a) Located at 6546 Pfeifer Ash Drive, Canal Winchester, OH 43110: On or about December 6, 2024, the employer did not ensure employees did not use the top of a portable ladder while framing a two-story residential home in that an employee was standing on top of a Werner 6 foot A-Frame ladder while assisting with framing.  b) Located at 6546 Pfeifer Ash Drive, Canal Winchester, OH 43110: On or about December 6, 2024, the employer did not ensure employees did not use the top of a portable ladder while accessing the second level of a tow-story residential home in that employees stood on top of a Werner 8 foot A-Frame ladder to access the second level.

As a result, employees were exposed to fall hazards greater than 16 feet while performing residential construction.  Saunders Construction LLC was previously cited for a violation of its equivalent Occupational Safety and Health standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1709514, citation number 3, item number 1 and was affirmed as a final order on February 27, 2024, with respect to a workplace located at 5922 Damsel Drive Lot 63 Columbus, OH 43232.
