29 CFR 1926.501(b)(1): Each employee on a walking/working surface having an unprotected side or edge which was six or more feet (1.8m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: On or about November 9, 2024, and times prior there to, building 400, employees were exposed to falls greater than six feet when accessing and egressing multi-level floors with unprotected sides. The landing on the second and third level where employees accessed ladders did not have fall protection installed.

29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: On or about November 9, 2024, and times prior there to, building 400, employees worked conducting construction activity at a height greater than six feet and not provided with fall protection. Employees installed rafters on a multi-story apartment building while standing on top edge boards.
