29 CFR  1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  In the following instances, employees were exposed to noise levels exceeding an 8-hour time weighted average of 85 decibels measured on the A scale, or equivalently a dose of fifty percent, and the employer did not have a hearing conservation program:   a. A line operator was exposed to continuous noise at 904.7% of the daily noise exposure (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of approximately 105.9 dBA during the 410-minute sampling period on November 13, 2023; exposure calculations included a zero increment for the 70 minutes not sampled.   b. A line operator was exposed to continuous noise at 1366.7% of the daily noise exposure (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of approximately 108.9 dBA during the 422-minute sampling period on November 13, 2023; exposure calculations included a zero increment for the 58 minutes not sampled.   c. A tube inspector was exposed to continuous noise at 285.9% of the daily noise exposure (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of approximately 97.6 dBA during the 183-minute sampling period on November 13, 2023; exposure calculations included a zero increment for the 297 minutes not sampled.   d. A crew lead was exposed to continuous noise at 418.2% of the daily noise exposure (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of approximately 100.3 dBA during the 423-minute sampling period on November 13, 2023; exposure calculations included a zero increment for the 57 minutes not sampled.   e.  An operator was exposed to continuous noise at 111.5% of the daily noise exposure (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of approximately 90.8 dBA during the 412-minute sampling period on November 13, 2023; exposure calculations included a zero increment for the 68 minutes not sampled.

29 CFR  1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:  On or about November 13, 2023, employees were exposed to respiratory hazards while voluntarily wearing elastomeric half mask respirators when observing a welding process and the employer did not ensure the employee was medically evaluated.

29 CFR  1910.1000(a)(2):Employee(s) were exposed to an airborne concentration of zinc oxide fume listed in Table Z-1 in excess of the 8 hour Time Weighted Average concentration of 5mg/m3:  In the�following instance,�an employee was exposed�to zinc oxide fume in excess�of the�permissible exposure�level (PEL)�for the�8-hour time�weighted average�concentration:   A line operator, who was observing a welding process, was exposed to zinc oxide fume at a time weighted average of 5.79 mg/m3.  This level exceeds the permissible exposure level for zinc oxide fume of 5 mg/m3 by 1.15 times.  This exposure was derived from a sample collected over a 405-minute sampling period on November 13, 2023.
