29 CFR  1917.112(b)(1): Guardrails were not provided at locations where employees were exposed to floor or wall openings or waterside edges, including bridges or gangway-like structures leading to pilings or vessel mooring or berthing installations, which presented a hazard of falling more than 4 feet or into the water.  (a) At junction between bridge walkway and gangway leading from upper work area to barge:  On or about 12/13/2023, and at times prior, the employer exposed employees to falls greater than four feet, in that no guardrails or other fall protection measure was in place at a 26-inch-wide gap between the bridge walkway and the gangway.

29 CFR  1917.152(d)(1)(vii): Compressed gas cylinders were not secured in an upright position.   (a) Storage shed / workshop, shore side:  On or about December 13, 2023, and at times prior, the employer exposed employees to struck by hazards in that three full acetylene cylinders and two full oxygen cylinders were not secured to protect them from falling in a storage shed / workshop full of clutter, tools, and other objects on a cement floor that could damage the valve if struck and cause a sudden release of the pressurized contents in close proximity to where individuals work.

29 CFR  1917.152(d)(1)(xvi): Oxygen cylinders were not separated from fuel gas cylinders and combustible materials by either a minimum distance of 20 feet (6.1 m) or a barrier having a fire-resistance rating of 30 minutes.  (a) Storage shed / workshop, shore side:  On or about December 13, 2023, and at times prior, the employer exposed employees to explosive and fire hazards in that four full acetylene cylinders and three full oxygen cylinders were stored in close proximity to each other and other flammable materials to include cardboard, rags, and petroleum products, in an enclosed space where individuals work with spark producing tools.
