29 CFR 1910.212(a)(1):Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. On or about October 13, 2023, the employer failed to ensure the operators of the Wheelabrator Machine were protected from the rotating parts of the machine's chain driven powered rollers and ingoing nip points created by the steel plates moving over the powered rollers by one or methods of machine guarding.

29 CFR 1904.39(a)(2):Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. On or about November 7, 2023, the employer did not report within 24 hours the amputation injury of an employee who received a fingertip amputation injury while operating a Wheelabrator machine at his workplace on or about October 13, 2023. The employer was notified the injury resulted in an amputation of left middle finger on or about November 6, 2023, and OSHA was not notified of the amputation injury until on or about November 22, 2023, via telephone.
