29 CFR 1910.134(c)(1): The respiratory protection program was not updated as necessary to reflect those changes in workplace conditions that affected respirator use:   (a) On or about November 30, 2023,  employees were exposed to respiratory hazards from chemicals such as, but not limited to; amorphous calcium-aluminum silicates (fly ash combustion residue), while using these chemicals in various phases of the wood treatment process. The employer did not provide medical evaluations to employees required to use the respirators as required in 1910.134(c)(1)(ii).  (b) On or about November 30, 2023, employees were exposed to respiratory hazards from chemicals such as, but not limited to; amorphous calcium-aluminum silicates (fly ash combustion residue), while using these chemicals in various phases of the wood treatment process. The employer did not provide fit testing procedures for tight-fitting respirators to employees required to use the respirators as required in 1910.134(c)(1)(iii).

29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function:  (a) On or about November 08, 2023, and at times prior, employees were exposed to health hazards while wearing a mandatory half-face respirator with facial hair that interfered with the seal.  Employees wear respirators with long facial hair while emptying bags of fly ash of all types (components include amorphous calcium-aluminum silicates, crystalline silica, calcium oxide, potassium oxide, phosphorus pentoxide) into the plant mixer drum.
