29 CFR  1910.120(q)(2): The employer did not develop an emergency response plan for emergencies which addressed the following minimum requirements of this standard: 1910.120(q)(2)(i) through 1910.120(q)(2)(xii):  On or about November 29, 2023, the employer failed to develop and implement an emergency response plan that included all required aspects. The employer's emergency response plan is deficient in several areas including: training and communication, decontamination, evacuation routes and procedures, and PPE and emergency equipment.

29 CFR  1910.120(q)(3)(iii):  Based on the hazardous substances and/or conditions present, the individual in charge of the ICS did not implement appropriate emergency operations and did not ensure that the personal protective equipment worn was appropriate for the hazards encountered:  On or about November 29, 2023, inside the shipping and receiving warehouse located at 6512 Blanchar's Crossing, Windsor, the Director of Operations, who was in charge of the emergency operation, did not ensure employees who were involved with the cleanup of the chemical spill of the ethyl acetate were wearing proper personal protective equipment.

29 CFR  1910.120(q)(6)(v): Incident commanders did not receive at least 24 hours of training equal to the first responder operations level and in addition have competency in the areas outline in 29 CFR 1910.120(q)(6)(v)(A) through (q)(6)(v)(F) and/or the employer did not so certify:   On or about November 29, 2023, inside the shipping and receiving warehouse located at 6512 Blanchar's Crossing, Windsor, employees who were involved with the cleanup of the chemical spill of the ethyl acetate in a defensive matter and placed absorbent materials to contain the spill, and repositioned the barrel of ethyl acetate to keep the chemical from spreading and preventing exposures. The incident commander directing the cleanup did not have at least 24 hours of training equal to the first responder operations level and in addition have competency in the areas outline in 29 CFR 1910.120(q)(6)(v)(A) through (q)(6)(v)(F).

29 CFR  1910.120(q)(11)(ii):  Where cleanup was done on plant property using plant or workplace employees, such employees had not completed the training requirements of 29 CFR 1910.38(a), 1910.134, 1910.1200, and other appropriate safety and health training made necessary by the task they were expected to perform such as personal protective equipment and decontamination procedures:  On or about November 29, 2023, inside the shipping and receiving warehouse located at 6512 Blanchar's Crossing, Windsor, the Forklift Operator, Terminal Manager, and Dock Lead involved with the cleanup of the chemical spill of the ethyl acetate were not properly trained on the emergency action plan, respiratory protection, and hazard communication.

29 CFR  1910.178(a)(6):  The user shall see that all nameplates and markings are in place and are maintained in a legible condition.  On or about November 29, 2023, the employer did not ensure markings including warning and caution labels were maintained in a legible condition. Clipboards were bolted onto each forklift partially covering up warning  labels.
