29 CFR  1926.451(a)(6): Scaffolds were not designed by a qualified person:  (a) On or about December 6, 2023, employees conducting residential sheathing work were exposed to fall hazards of approximately 12ft. 10 inches on the south side of the building, while standing on top of sheathing that was elevated by a JLG Sky Trak (Model: 6042), and the sheathing used as a scaffold was not designed by a qualified person to be utilized as scaffold platform.

29 CFR  1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  (a) On or about December 6, 2023, employees conducting residential sheathing work were exposed to fall hazards of approximately 12ft. 10 inches on the south side of the building, while standing on top of sheathing that was elevated by a JLG Sky Trak (Model: 6042) rough terrain forklift.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a) On or about December 6, 2023, employees conducting residential framing and sheathing work were exposed to fall hazards of approximately 12ft. 10 inches on the south side of the building and approximately 10 feet 3 inches on the west side of the building.   JBL Craftsman Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard (name previously cited standard), which was contained in OSHA inspection number 1490308, citation number 1, item number 1 and was affirmed as a final order on October 6, 2020, with respect to a workplace located at 1365 Ponovoma Court, Hartland, Wisconsin.  JBL Craftsman Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard (name previously cited standard), which was contained in OSHA inspection number 1462076, citation number 1, item number 1 and was affirmed as a final order on March 12, 2020, with respect to a workplace located at W136N6255 Hummingbird Way in Menomonee Falls, Wisconsin.

The employer failed to certify that they have been trained on the use and limitations of the JLG Sky Trak (Model: 6042).
