29 CFR 1910.178(m)(5)(ii): A powered industrial truck was left unattended when the operator is 25 ft. or more away from the vehicle which remains in view, or whenever the operator leaves the vehicle, and it is not in view: a) Construction Site: On or about December 06, 2023, as the controlling employer, Blue Planet Metals, Inc., did not ensure their subcontractor, Saul Fuentes Roofing, protected their employees in that employees were exposed to struck by hazards from the unoccupied Genie GHT 636 All Terrain Forklift with a load of roofing material suspended. The powered industrial truck was left unattended when the operator was out of sight of the truck. This provision is applicable to construction work as incorporated by reference in 1926.6(e)(16) ANSI B56.1-1969, Safety Standards for Powered Industrial Trucks, IBR approved for §1926.602(c).

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) Construction Site: On or about December 06, 2023, as the controlling employer, Blue Planet Metals, Inc., did not ensure their subcontractor, Saul Fuentes Roofing, protected their employees in that employees were exposed to fall hazards of approximately 30 feet to the ground below while accessing/egressing the roof. The ladder was not secured at its top to a rigid support, and a grasping device, such as a grabrail, was not provided to assist employees in mounting and dismounting the ladder.
