29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) Construction Site: On or about December 05, 2023, employees were exposed to fall hazards of approximately 22 feet to the ground below while setting floor joists on the second level of the new commercial building without fall protection. b) Construction Site: On or about December 05, 2023, employees were exposed to fall hazards of approximately 22 feet to the ground below while sheathing the third level of the new commercial building without fall protection.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purposes for which they were designed: a) Construction Site: On or about December 05, 2023, as the controlling employer, Baker Companies did not ensure their subcontractors, Many C.M.G. protected their employees in that employees were exposed to fall hazards while using a self-supporting ladder in a manner it was not designed for. The six-foot fiberglass step ladder was a self-supporting ladder being used as a non-self-supporting ladder.
