29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) On December 7, 2023, at the above addressed jobsite, employees performing installation of a roof on a residential home, approximately 12 and 20 feet above the surface below, were not utilizing fall protection, thereby exposing the employees to fall hazards. No abatement certification or documentation is required for this item. Rako Roofing Inc. was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1536005, citation number 1, item number 2 and was affirmed as a final order on July 14, 2021, with respect to a workplace located at 839 South Dryden Place in Arlington Heights, Illinois. Rako Roofing Inc. was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13), which was contained in OSHA inspection number 1443257, citation number 2, item number 1 and was affirmed as a final order on February 11, 2020, with respect to a workplace located at 320 Norman Court in Des Plaines, Illinois.

29 CFR 1926.1053(b)(22): Employees using ladders were carrying objects or loads that could cause them to lose balance and fall: a) On December 7, 2023, at the above addressed jobsite, an employee was exposed to the hazard of falling approximately 12 feet when climbing a portable ladder carrying material to the roof. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET). Rako Roofing Inc. was previously cited for a violation of this occupational safety and health standard 1926.1053(b)(22), which was contained in OSHA inspection number 1443257, citation number 1, item number 3 and was affirmed as a final order on February 11, 2020, with respect to a workplace located at 320 Norman Court in Des Plaines, Illinois.
