29 CFR  1910.219(d)(1): Guarding. Pulleys, any parts of which are seven (7) feet or less from the floor or working platform, shall be guarded in accordance with the standards specified in paragraphs (m) and (o) of this section. Pulleys serving as balance wheels (e.g., punch presses) on which the point of contact between belt and pulley is more than six feet six inches (6 ft. 6 in.) from the floor or platform may be guarded with a disk covering the spokes.   a.) On or about December 8, 2023, the employer did not ensure that the belt conveyor, located at the Stacker which carries pea gravel, sand, and limestone to bins inside the batch plant, did not have a guard enclosing the tail pulley on the load side of the conveyor located at ground level exposing employees to rotating machinery.

29 CFR  1910.1200(g)(1): Chemical manufacturers and importers shall obtain or develop a safety data sheet for each hazardous chemical they produce or import. Employers shall have a safety data sheet in the workplace for each hazardous chemical which they use.  a.) On or about December 8, 2023, the employer did not have an SDS in the workplace for Bradley Inc. Chemicals, CR-50 (corrosive, respiratory irritation), used my Mixer Operators on a daily basis to clean cement off the concrete truck windshields.

On or about December 28, 2023, the employer did not ensure that employees received training on the presence of respirable crystalline silica in the workplace in that employees were not aware of its presence in the components of SRM Concrete, Ready-Mix Concrete (Carcinogen).
