29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury. a) Excavation located at 6415 Atlanta Highway, Alpharetta, GA 30004. On or about 12/12/2023, the employer exposed employees to struck-by hazards and potential engulfment hazards, in that head protection was not provided and or used in and around an excavation and swing radius of a mini excavator. Also employee accessing the trench was not provided with a ladder or other safe means of egress. The employer failed to eliminate hazards prior to the start of work.
