29 CFR  1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights) more than 6 feet above lower levels by personal fall arrest systems, covers, or guardrail systems erected around such holes:  a) On or about October 16, 2023, employees were working on the third floor and the roof of a building under construction and were not protected from falling approximately 10 feet through floor holes to the lower level.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.501(b)(14):  Each employee working on, at, above, or near wall openings (including those with chutes attached) where the outside bottom edge of the wall opening is 6 feet or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches above the walking/working surface, were not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system:   a)  On or about October 16, 2023 , employees engaged in framing carpentry work were not protected from fall hazards while working around unguarded wall openings on the second and third floors.  b) On or about October 16, 2023, employees engaged in framing work around unprotected elevator shafts approximately three stories above the ground, were not protected from the hazard of falling.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1926.416(a)(1):  The employer permitted an employee to work in such proximity to any part of an electric power circuit that the employee could contact the electric power circuit in the course of work and was not protected against electric shock by deenergizing the circuit and grounding it or by guarding it effectively by insulation or other means:  a) On or about October 16, 2023, employees performing framing carpentry work to a new structure were permitted to work in proximity to energized overhead powerlines and were not protected against electric shock. North Shore Framing Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(1), which was contained in OSHA inspection number 1656841, citation number 1, item number 1 and was affirmed as a final order on July 12, 2023, with respect to a workplace located at 1708 Oak Ave., Evanston, IL 60201.  North Shore Framing Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1613708, citation number 1, item number 2 and was affirmed as a final order on December 28, 2022, with respect to a workplace located at 2140 N Rockwell St., Chicago, IL 60647.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

The stairway that was utilized was not equipped with a stair rail system thereby exposing themselves to falls.
