29 CFR 1910.212(a)(1): The employer failed to provide one or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: a. Kitchen - On or about December 14, 2024, the employer failed to provide effective guarding to protect employees working at or near the Mixer Direct mixers that blend pactin, sugar, and water with an approximately 17-inch stainless steel rotating shaft. A kitchen agent running batches of gummies was exposed to rotating parts while their hands were approximately six (6) inches away from four (4) inches of the exposed rotating shaft.

29 CFR 1910.212(b): The employer failed to ensure machines designed for a fixed location were securely anchored to prevent walking or moving. a. On or about December 4, 2023, in the panning area, the employer failed to protect kitchen agent employees while operating the unanchored #2 yellow striped Latini chocolate panning machine. The machine exposed employees to struck-by hazards when the panner moved in an uncontrolled manner as the hose connected to the arm for drizzling chocolate became entangled around the drum of the panner.
