29 CFR  1926.651(j)(1): Adequate protection was not provided to protect employees from loose rock or soil that could pose a hazard by falling or rolling from an excavation face:  a) On or about December 14, 2023, in an excavated retention pond on the southeast side of the construction site, where employees were not protected from loose soil falling from the face of the excavation wall, exposing employees to struck-by and engulfment hazards.

29 CFR  1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  a) On or about December 14, 2023, in an excavated retention pond on the southeast side of the construction site, where employees were exposed to a struck-by and engulfment hazards while inside an excavation whose spoil pile was within 24 inches of its edge.

29 CFR  1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:  a) On or about December 14, 2023, in an excavated retention pond on the southeast side of the construction site, where the persons making inspections of the excavation and adjacent work area were not competent in that they were unaware of the requirements of 1926 Subpart P and they were unaware of the correct protective systems to used for Type B soil, exposing employees to struck-by hazards.

29 CFR  1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  a) On or about December 14, 2023, in an excavated retention pond on the southeast side of the construction site, where employees were exposed to a cave-in hazard when digging for a retaining wall inside an excavation greater than 5 feet without a protective system.
