29 CFR  1910.28(b)(1)(i):  Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  a. MTD Products, Inc. dba Stanley Black & Decker - Willard, Ohio: On or about December 15, 2023, employees were exposed to fall hazards of approximately 12-feet and nine inches when accessing the top of the Line 2 Dry-Off Oven for tasks such as, but not limited to, preventive maintenance and troubleshooting.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR  1910.333(a): Safety-related work practices were not employed to prevent electric shock or other injuries resulting from either direct or indirect electrical contacts, when work was performed near or on equipment or circuits which were or could be energized.  MTD Products, Inc. dba Stanley Black & Decker - Willard, Ohio: On or about December 15, 2023, the employer did not develop and implement electrical safety related work practices (ESRWP) which cover employees exposed to live electrical conductors.  Employees responsible for performing electrical tests and fuse replacement in a 480-volt 60-amp electrical distribution panel for the dry-off oven were exposed to electrical hazards in that ESRWP such as, but not limited to, alerting techniques, approach boundaries/body positioning, deenergization, and electrical protective equipment, were not employed to prevent electrical shock and/or arc flash/blast injuries.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR  1910.333(c)(2): The employer did not ensure that only qualified persons were working on energized circuits and that qualified persons were familiar with the proper use of special precautionary techniques, personal protective equipment, insulating and shielding materials, and insulated tools.  a. MTD Products, Inc. dba Stanley Black & Decker - Willard, Ohio:  The employer did not ensure that workers who accessed the 480-volt\60 amp oven control electrical distribution panel for troubleshooting tasks were qualified.  Employees were not trained on procedures for working safely on energized parts in that employees were not familiar with the proper personal protective equipment while voltage testing energized parts.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. MTD Products, Inc. - dba Stanley Black & Decker - Willard, Ohio:   On or about December 15, 2023, the employer did not ensure employees were protected from electrical hazards in that rubber insulated and leather gloves, hard hat, and arc rated face shield were not provided to employees who accessed the 480-volt/60-amp oven control electrical distribution panel. Employees were exposed to electrocution, shock, and arc flash/blast while troubleshooting/voltage testing within the panel.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
