29 CFR 1910.179(b)(6)(ii):Where passageways or walkways were provided, obstructions were so placed that the safety of personnel was jeopardized by movements of crane(s): On or about September 9, 2023 at 140 North West Avenue, Youngstown, OH 44502, the employer failed to ensure employees utilizing the 25 ton crane 9 located in bay 2 were protected from being struck by the load due to location in that, an employee was struck while using Crane 9 to clean up steel from the floor and dump into the dump skid. An employee could not move out of the way of the load and was struck by the load.

29 CFR 1910.179(n)(3)(iii)(a): During hoisting, care was not taken that there was no sudden acceleration or deceleration of a moving load. On or about September 9, 2023 at 140 North West Avenue, Youngstown, OH 44502, the employer failed to ensure employees utilizing the 25 ton crane 9 located in bay 2 were protected from being struck by the load due to location in that, an employee was struck while using Crane 9 to clean up steel from the floor and dump into the dump skid. The crane was being utilized in a pendulum type motion to pick up steel on the floor and could not be stopped in time.

29 CFR 1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye: On or about September 19, 2023, the employer failed to report the in-patient hospitalization of an employee who sustained a broken leg which required surgery when they were struck by a load being moved by Crane 9 within 24 hours. The employee was hospitalized for 3 days after the incident and never returned to work.
