29 CFR 1926.502(a)(2): The employer did not provide and install all fall protection systems required by this subpart for employee(s) and did not comply with all other pertinent requirements of this subpart before an employee(s) began the work that necessitates the fall protection. a) New residential construction on Lot #662 located at 400 Crystal Lake Parkway, Hoschton, GA 30548, Roof: On or about 12/28/2023, the employer exposed employees to fall hazards of 20-feet to the lower level, in that fall protection system provided was not used as intended. The fall protection system was used without the metal roof anchor and the life-line was tied at the ridge in a knot without a snap lock connector as provided with the system.

29 CFR 1926.503(a)(2)(ii): The employer did not assure that each employee, as necessary, had been trained by a competent person in the correct procedures for erecting, maintaining, disassembling and inspecting the fall protection systems to be used: a) New residential construction on Lot #662 located at 400 Crystal Lake Parkway, Hoschton, GA 30548, Roof: On or about 12/28/2023, the employer exposed employees to fall hazards approximately 20-feet to the lower ground level, in that employees were not trained to erect and inspect fall protection systems before the shift began to eliminate potential falls due to system failure as fall protection systems were not used as intended by the manufacturer.

29 CFR 1926.552(a)(4): Hoisting ropes were not installed in accordance with the wire rope manufacturers' recommendations. a) New residential construction located on Lot #661 at 400 Crystal Lake Parkway Hoschton, GA 30548, Ground level: On or about 12/28/2023, the employer exposed employees to struck-by hazards while operating a TranzSporter TP250 , in that the manufactured installed wire rope was replaced by a nylon climbing rope which is not a manufacturer's recommendation for a replacement cable.
