29 CFR 191O.l 200(h)(2)(iii): The employer did not provide information to the employees as to the location and availability of the written hazard communication program, and material safety data sheets required by 29 CFR 1910.1200: (Construction Reference: 1926.59)  On or about December 27, 2023, and at times prior, thereto, at 2350 Beacon Lane, Naples, Florida, 34103, an employee was exposed to a chemical hazard while working with a hazardous waterproofing material (i.e. Sto Watertight Coat Grey Component B - Product Code: 81241-025 containing Portland cement) without receiving effective information on the availability of the product's safety data sheet, and contents of the company's hazard communication program.

29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:(as incorporated by reference under 29 CFR  1926.103):  On or about December 27, 2023, at times prior, thereto, at 2350 Beacon Lane, Naples, Florida, 34103, the employer did not establish and implement a written respiratory protection program for an employee required to use a half-face elastomeric respirator while working with a hazardous waterproofing material (i.e. Sto Watertight Coat Grey Component B - Product Code: 81241-025 containing portland cement), thus exposing the employee to a chemical hazard.
