The user shall see that all nameplates and markings are in place and are maintained in a legible condition. a) On or about January 09, 2024, the employer did not ensure that the data plate was maintained in a legible condition on the Forklift - Crown CRW Lift - Model C51000-60, which is utilized daily. b) On or about January 09, 2024, the employer did not ensure that the data plate was maintained in a legible condition on the Forklift - Toyota Mid IC Cushion Lift - Model 8FGCU30, which is utilized daily.

29 CFR 1910.178(l)(1)(i): Powered Industrial Trucks. Operator training. Safe operation. The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). a) On or about January 09, 2024 the employer had not ensured that employees operating the Forklift - Crown CRW Lift - Model C51000-60 and Forklift - Toyota Mid IC Cushion Lift - Model 8FGCU30 received adequate training to be competent operators in that operators were not performing daily inspections of the forklifts to ensure the forklifts were in good condition prior to operating. The forklifts conditions were such as but not limited to broken tires, broken horn, missing date plates, and a broken seat.

29 CFR 1910.178(q)(1): Powered industrial trucks. Maintenance of industrial trucks. Any power-operated industrial truck not in safe operating condition shall be removed from service. All repairs shall be made by authorized personnel. a) On or about January 09, 2024, employer did not ensure that the Forklift - Crown CRW Lift - Model C51000-60 that was not in safe operating condition were removed from service until repairs were made in that the Crown CRW Lift - Forklift did not have tires in proper functioning conditions, the horn was missing and the seat was broken. b) On or about January 09, 2024, the employer did not ensure that the Forklift - Toyota Mid IC Cushion Lift - Model 8FGCU30 that was not in safe operating condition were removed from service until repairs were made in that the Toyota Forklift did not have tires in proper functioning conditions.

29 CFR 1910.178(q)(7): Powered industrial trucks. Operation of the truck. Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. a) On or about January 09, 2024 employer did not ensure that daily inspections conducted were adequate prior to utilizing the Crown CRW Lift - Model C51000-60 and Toyota Mid IC Cushion Lift - Model 8FGCU30 on a daily basis and during multiple shifts, in that the Crown CRW Lift - had broken tires, broken horn, broken seat and the Toyota Mid IC had broken tires and bent tire rims.
