The employer did not furnish the abatement required for citations issued within 10 calendar days for Citation No. 1 Item No(s). 1a nor did they respond to the progress report letter sent November 21, 2022.

29 CFR  1926.451(c)(1):Supported scaffolds with a height to base width (including outrigger supports, if used) ratio of more than four to one (4:1) were not restrained from tipping by guying, tying, bracing, or equivalent means.  Site- Employees erecting a mobile baker scaffold 2 feet 5 inches in width was not restrained from tipping when the working platform height exceed 9 feet 8 inches in height. An employee working from the top of a double stacked baker scaffold, with a working height of 11 feet 6 inches, was not restrained from tipping while the third baker scaffold was added to the top of the mobile scaffold.

29 CFR  1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:; Such activities were not performed only by experienced and trained employees selected for such work by the competent person.  Site- An employee working from the top of a double stacked baker scaffold, with a working height of 11 feet 6 inches and a width of 2 feet 5 inches, was not restrained from tipping while the third baker scaffold was added to the top of the mobile scaffold. The employer did not provide a competent person to erect a triple stacked baker scaffold where the scaffold was not secured from tipping and adequate fall protection was not provided.

29 CFR  1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.   Site- Employees exposed to a fall and scaffold tipping hazard while erecting and working from the top of a double stacked baker scaffold were not provided with scaffold training from the employer.
