29 CFR 1910.1450(e)(3)(iii): The employer's Chemical Hygiene Plan did not include a requirement that fume hoods and other protective equipment functioned properly and did not include specific measures that would be taken to ensure proper and adequate performance of such equipment: a) On or about January 12, 2024, in the lab, employees analyzing organic vapors such as, but not limited to nitric acid and hydrogen chloride while using an operational fume hood that did not capture all fumes in that Hood 1 did not have a capture velocity of at least 100 feet per minute. On or about January 12, 2024, in the lab, employees engaged in analyzing organic vapors such as, but not limited to nitric acid and hydrogen chloride used a fume hood that was not incompliance with the hygiene plan in the following instances: b) Hood 1, the maximum sash opening was not measured and marked clearly and legibly at the working height; c) Hood 2, the maximum sash opening was not measured and marked clearly and legibly at the working height; d) Hood 3, the maximum sash opening was not measured and marked clearly and legibly at the working height; e) Air velocity measurements were taken annually instead of every six months; f) Records of the velocity readings for each hood were not maintained for comparison.
