29 CFR 1910.219(e)(2)(i): Overhead horizontal belts, with lower parts seven (7) feet or less from the floor or platform, shall be guarded on sides and bottom in accordance with paragraph (o)(3) of this section. On or about January 10, 2024, at the facility located at 4243 Gateway Drive, Sheboygan, Wisconsin; the employer failed to ensure horizontal belts lower than seven feet from the floor were properly guarded. Specifically, the guard did not fully enclose the bottom run of the south discharge conveyor drive belt on Bag House #14.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6): On or about January 10, 2024, at the facility located at 4243 Gateway Drive, Sheboygan, Wisconsin; employees were exposed to machine hazards associated with moving parts when they engaged in troubleshooting the Bag House #14 south discharge conveyor. The employer did not ensure that employees implemented energy control application steps or equivalent protective measures prior to allowing them to lift up the south discharge conveyor drive belt guard. The machine was not deenergized prior to employees engaging in the servicing / maintenance activity. As a result, the remaining applicable energy control elements, involving machine isolation [1910.147(d)(3)], lockout/tagout device application [1910.147(d)(4)], dissipation of residual energy [1910(d)(5)(i)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine hazards.
