29 CFR 1910.147(c)(4)(ii): The procedures shall clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, the following:  a. On or about January 4, 2024, employees performed maintenance, setup/changeover, and/or cleaning activities on the U.S. Industrial Machinery Hydraulic Shear Model US825. The energy control procedure developed by the employer, Work Instructions-Hazardous Energy Control - Lockout/Tagout WI4.9, did not contain clear and specific instructions related to the shear being serviced to include:  (1)	A specific statement of the intended purpose and use of the procedure [(c)(4)(ii)(A)] (1)	Specific procedural steps for shutting down the equipment, identifying and isolating the electrical, pneumatic, and hydraulic energy, and securing the energy isolating device(s) in order to control the energy in the system. [(c)(4)(ii)(B)] (2)	Specific steps for the removal and/or transfer of lockout devices [(c)(4)(ii)(C)] (3)	Specific steps to verify the effectiveness of the lockout measures [(c)(4)(ii)(D)]  b. On or about January 11, 2024, employees performed maintenance, setup/changeover, and/or cleaning activities on the Nisshinbo HIQ-1250 CNC Punch Press. 29 CFR 1910.147(d): Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence as required by 29 CFR 1910.147(d)(1) through (d)(6):  a. On or about January 11, 2024, employees were exposed to machine hazards associated with moving parts and pinch points while performing cleaning and setup/changeover activities on the U.S. Industrial Machinery Hydraulic Shear Model US825. The employer did not ensure that energy control application steps were implemented as the machine was not shut down or turned off to perform the servicing work [per the 1910.147(d)(2) requirements]. As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)], dissipation of residual energy [(d)(5)(i)], and verification of isolation [(d)(6)], were not implemented to protect employees from machine servicing hazards.    b. On or about January 11, 2024, employees were exposed to machine hazards associated with moving parts and pinch points while performing cleaning and setup/changeover activities on the Nisshinbo HIQ-1250 CNC Punch Press. These activities include, but are not limited to, setup, changeover, maintenance, and cleaning.  b. 29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  a. On or about January 4, 2024, at the U.S. Industrial Machinery Hydraulic Shear, Model US825, the employer did not ensure that the machine's finger guard was lowered into position when employees operated the machine during production to cut small aluminum parts. The raised guard and disabled safety switch exposed employees to the pinch point hazards located under the hold down springs and the knife blades of the shear.   b. On or about January 11, 2024, at the Nisshinbo HIQ-1250 CNC Punch Press, the employer did not ensure that employees were protected from being struck by the moving steel table while the machine is in operation and/or caught between the moving table and the safety railing near the exit of the operator's station.   c. On or about January 11, 2024, at the #635 Clausing Drill Press, Model # 1765, the employer did not ensure that employees were protected from contacting the rotating chuck and/or struck by flying shavings while operating the press.

The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.  a. On or about January 11, 2024, at the PH Hydraulic Punch press, Model# OGF30, the employer did not ensure that employees were protected from being caught between the dies of the press during normal production while loading and holding material and cycling the press with a foot treadle.
