29 CFR 1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person designated by the employer. On or about January 11, 2024, and at times prior, at 5715 Double Eagle Circle, Ave maria, Florida, the employer failed to maintain a program of frequent and regular inspections by a competent person, including failing to inspect a worksite to ensure a means of conventional fall protection system was installed and used by employees working at least six feet above ground level while working on trusses and/or installing facia on a new residential construction, thus exposing employees to a fall hazard.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On or about January 11, 2024 and at times prior, at 5715 Double Eagle Circle, Ave Maria, Florida, the employer failed to ensure that employees were protected from fall hazards in that employees were working on trusses and/or installing facia at least six feet above ground level without wearing fall protection.
