29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: This violation occurred on January 17, 2024, at 6790 Highway 81 Grafton, ND, when the employer did not develop and administer a hearing conservation program as described in 29 CFR 1910.95(c) through (o) for employees exposed to noise from potato packaging machines that exceeded an 8-hour time-weighted average (TWA) of 85 decibels: (a) An Operator was exposed to continuous noise levels at 77.9% of the permissible 8-hour time-weighted average (TWA). The equivalent decibel (dBA) level of 77.9% is approximately 88.1 dBA. Sampling was performed for 464 minutes during one shift. (b) An Operator was exposed to continuous noise levels at 60.7% of the permissible 8-hour time-weighted average (TWA). The equivalent decibel (dBA) level of 60.7% is approximately 86.4 dBA. Sampling was performed for 463 minutes during one shift. (c) A Grader was exposed to continuous noise levels at 96.2% of the permissible 8-hour time-weighted average (TWA). The equivalent decibel (dBA) level of 96.2% is approximately 89.7 dBA. Sampling was performed for 465 minutes during one shift. (d) A Stacker was exposed to continuous noise levels at 60.2% of the permissible 8-hour time-weighted average (TWA). The equivalent decibel (dBA) level of 60.2% is approximately 86.3 dBA. Sampling was performed for 463 minutes during one shift.
