29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a- 77 Tower Boulvard, Eastampton NJ:  The company worksite Foreman was exposed to fall hazards in excess of 10 feet 5 inches to ground surface below, when walking and working from a residential structure's exterior wall top plates without the use of fall protection.  Condition noted on or about 01/18/24.

29 CFR  1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii).   a- 77 Tower Boulvard, Eastampton NJ:  The company worksite Foreman was exposed to fall hazards in excess of 10 feet 5 inches to ground surface below, when walking and working from a residential structure's exterior wall top plates without the use of fall protection.  The company worksite Foreman and their worksite worker were not trained on fall protection means and methods as specified in 29 CFR 1926.503(a)(2)(i) through (viii).  Condition noted on or about 01/18/24.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    a- 77 Tower Boulevard, Eastampton NJ:  The company worksite Foreman was exposed to fall hazards, in excess of 10 feet 5 inches to ground surface below, when accessing to and egressing from an upper landing surface using an aluminum extension ladder whose side rails did not extend at least three feet above this surface. Condition noted on or about 01/18/24.
