29 CFR  1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii).   a- 203 Ark Road, Building 1300, Mount Laurel NJ:  Two company workers were exposed to fall hazards, in excess of 10 feet 7 inches and 11 feet 9 inches, when walking and working at and near a commercial structure's second floor unprotected wall openings while not using fall protection.  The company worksite Foreman and their worksite workers were not trained on fall protection means and methods as specified in 29 CFR 1926.503(a)(2)(i) through (viii).  Condition noted on or about 09/12/24.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:    a- 203 Ark Road, Building 1300, Mount Laurel NJ:  Two company workers were exposed to fall hazards, in excess of 10 feet 7 inches to the concrete flooring below, when accessing to and egressing from a commercial structure's second floor using a damaged aluminum extension ladder. Condition noted on or about 09/12/24.

29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a- 203 Ark Road, Building 1300, Mount Laurel NJ:  Two company workers were exposed to fall hazards, in excess of 10 feet 7 inches and 11 feet 9 inches, when walking and working at and near a commercial structure's second floor unprotected wall openings while not using fall protection.  Condition noted on or about 09/12/24.  New Zyland Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.501(b)(13)), which was contained in OSHA inspection number 1747265, citation number 2, item number 2 and was affirmed as a final order on August 1, 2024, with respect to a workplace located at Bellevue Estates; Glenwood Avenue & Bunker Hill Way, Syracuse NY.
