29 CFR  1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii).   a- 3191 Route 206, Columbus NJ:  Company workers were exposed to fall hazards in excess of 13 feet 3 inches to ground surface below, when walking and working at and near unprotected edges and sides while not using fall protection.  These unprotected edges and sides  were located on the top of a commerical structure's addition.  These workers and their worksite Foreman were not trained on fall protection means and methods as specified in 29 CFR 1926.503(a)(2)(i) through (viii).  Condition noted on or about 01/18/24.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.1051(a): Stairways or ladders were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist was provided:   a- 3191 Route 206, Columbus NJ: A worker, not provided with a ladder, was exposed to fall hazards in excess of 12 feet 2 inches when sliding down a diagonal wall brace to access the concrete flooring below.  Condition noted on or about 01/18/24.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.   a- 3191 Route 206, Columbus NJ: Workers, not provided with eye/face protection, were exposed to eye injuires when using air nailers during framing and other related activities.  Condition noted on or about 01/18/24.  Starmax Construction, LLC. was previously cited for a Serious violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.102(a)(1)), which was contained in OSHA inspection number 1466181, citation number 1, item number 1 and was affirmed as a final order on 04/28/20, with respect to a workplace located at Joseph Drive, Newton NJ.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   a- Side & Rear of Structure, 3191 Route 206, Columbus NJ: Workers were exposed to fall hazards, in excess of 13 feet 3 inches to the ground surface below, when walking and working at and near the unprotected sides and edges while on top of a commerical structure's addition while not using fall protection.  Condition observed on or about 01/18/24.   StarMax Construction, LLC. was previously cited for a Repeat violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1526691, citation number 1, item number 1 and was affirmed as a final order on 06/21/21, with respect to a workplace located at Gabriella Way, Newton NJ.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
