29 CFR 1910.176(a): Where mechanical handling equipment was used, sufficient safe clearances was not allowed for aisles, at loading docks, through doorways and wherever turns or passage were made. Aisles and passageways were not kept clear and in good repair, with no obstruction across or in aisles that could create a hazard. Permanent aisles and passageways were not appropriately marked: At the workplace located at 21999 U.S. 54, Goddard, Kansas 67052, employees engaged in operating a powered industrial truck (PIT) at the pallet sorting area of the facility were exposed to struck-by hazards. The pallet sorting area was not kept free of obstruction across or in aisles. Forklift operators were exposed to struck-by hazards related to limited visibility due to pallets stored within permanent aisles and passageways.

29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not provided to the operator when the operator has been involved in an accident or near-miss incident: At the workplace located at 21999 U.S. 54, Goddard, Kansas 67052, employees were exposed to struck-by hazards. An employee operating a forklift did not receive refresher training after being involved in a near-miss incident in October of 2023. The operator was involved in a powered industrial truck (PIT) incident on January 16, 2024.
