29 CFR 1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  a) Lot 16, Hawthorne Drive, Harrisburg, PA 17110, unfinished stairway landing between the first and second floors, on or about January 23, 2024, employees were exposed to a fall hazard of approximately 7-feet through an exterior wall opening to the ground below.  The wall opening was not equipped with a top rail, and personal fall arrest systems were not in use.  b) Lot 16, Hawthorne Drive, Harrisburg, PA 17110, second floor, on or about January 23, 2024, employees were exposed to a fall hazard of approximately 10-feet through exterior wall openings to the ground below.  The wall openings was not equipped with a top rails, and personal fall arrest systems were not in use.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.1053(b)(4):  Ladder(s) were used for purposes other than the purpose for which they were designed.  a) Lot 16, Hawthorne Drive, Harrisburg, PA 17110 - On or about January 23, 2024, employees were accessing a stairway landing of the residential structure by way of a 6-foot Werner, fiberglass, folding stepladder that was in the folded position and set on unstable plywood.  The ladder was not being used for the purpose for which it was designed by the manufacturer.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR 1926.1053(b)(1):  Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.  a) Lot 16, Hawthorne Drive, Harrisburg, PA 17110 - On or about January 23, 2024, employees were using a 6-foot Werner, fiberglass, folding stepladder to access the landing surface of an unfinished stairwell, and the ladder only extended approximately one-foot above the landing surface.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.
