1926.20(b)(2) Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. 29 CFR 1926.453(b)(2)(v): A body belt (harness) shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. a) On or about 01/31/2024, during the construction of the new Quicklies , located on Chili Avenue in Rochester, New York, the employer did not enforce the use of fall protection for employees working in the basket of an aerial boom lift 12 feet above lower levels. Employees were allowed to work in an aerial lift without the use of Personal Fall Arrest Systems such as "tying off" to the boom basket with a harness and lanyard. NO ABATEMENT CERTIFICATION REQUIRED
