29 CFR  1910.1200(e)(1):  Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:  On or about February 7, 2024, at a facility located at 704 Industrial Way in Colby, WI; the employer did not develop a written hazard communication program when employees worked with hazardous chemicals such as but not limited to warehoused chemicals (oxidizers, flammables, corrosives, irritants and toxic chemicals) and sanitation chemicals.

29 CFR  1910.1200(h)(3)(i):  Employee training shall include the methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area (such as monitoring conducted by the employer, continuous monitoring devices, visual appearance or odor of hazardous chemicals when being released, etc.):  On or about February 7, 2024, at a facility located at 704 Industrial Way in Colby, WI; the employer did not provide training to employees that included methods and observations that may be used to detect the presence or release of hazardous chemicals in the work area when employees worked with hazardous chemicals such as but not limited to warehoused chemicals (oxidizers, flammables, corrosives, irritants and toxic chemicals) and sanitation chemicals.

29 CFR  1910.1200(h)(3)(iii):  Employee training shall include the measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used:   On or about February 7, 2024, at a facility located at 704 Industrial Way in Colby, WI; the employer did not provide training to employees that included the measure employees could take to protect themselves from hazardous chemicals in the workplace such as but not limited to warehoused chemicals (oxidizers, flammables, corrosives, irritants and toxic chemicals) and sanitation chemicals. Employees were not provided training on appropriate work practices when cleaning up small leaks, or specific emergency procedures in the event of a large release or chemical reaction.

29 CFR  1910.132(d)(2):  The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment:  On or about February 7, 2024, at a facility located at 704 Industrial Way in Colby, WI; the employer did not verify through written certification that a workplace hazard assessment for personal protective equipment (PPE) had been conducted. The employer identified PPE that was necessary or just available for use based on hazards identified in the workplace. The employer did not document the workplace evaluated, the date of the assessment or the person certifying the assessment.
