29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury:  a) New residential construction located at450 Stoneybrook Rd. (Lot# 219-222 Mountain Park Subdivision) Dahlonega, GA 30533 Roof: On or about 02/08/2024, and at times prior, the employer exposed employees to struck-by hazards while operating pneumatic nail guns, in that protective eyewear, was not provided while installing various framing material.  Damian Ponce Loredo LP was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1649264, citation number 1, item number 1 and was affirmed as a final order on June 26, 2023, with respect to a workplace located at 4635 Trefoil Path (Lot# 148 Bramblett Grove Subdivision) Cumming, GA 30040.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) New residential construction located at 450 Stoneybrook Rd. (Lot# 219-222 Mountain Park Subdivision) Dahlonega, GA 30533 Roof: On or about 02/08/2024, the employer exposed an employee to fall hazards of approximately 19-feet, 9-inches to the lower ground level, in that an adequate fall protection system was not provided or utilized while working from the roofing system.  b) New residential construction located at 450 Stoneybrook Rd. (Lot# 219-222 Mountain Park Subdivision) Dahlonega, GA 30533, Second floor: On or about 02/08/2024, the employer exposed an employee to fall hazards of approximately 11-feet, 8-inches to the lower ground level, in that an adequate fall protection system was not provided or utilized while working from the second-floor area.  Damian Ponce Loredo LP was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1649264, citation number 2, item number 1 and was affirmed as a final order on June 26, 2023, with respect to a workplace located at 4635 Trefoil Path (Lot# 148 Bramblett Grove Subdivision) Cumming, GA 30040.
