29 CFR 1910.132(c): Personal protective equipment was not of safe design and construction for the work to be performed: On or about February 7, 2024, an employee was exposed to a fall while working on a ladder positioned on a catwalk between the steeping tanks. The employee was provided a Guardian Shock Absorber Lanyard that was attached to a top rail of a guardrail system below him. The Guardian Shock Absorber Lanyard was not designed or constructed to have the employee's D-ring positioned above the anchorage connector, unless permitted by specific application or combination of equipment.

On and before February 7, 2024, an employee worked from a ladder on the catwalk between the steeping tanks with a personal fall protection system that was anchored to the catwalk guardrail. The guardrail was not capable of supporting at least 50000 pounds.

29 CFR 1910.147(c)(4)(ii): Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A), (c)(4)(ii)(B), (c)(4)(ii)(C) and (c)(4)(ii)(D): On or about March 14, 2024, the employer developed procedures for a cleaning operation of four kettles that did not clearly and specifically outline the scope, purpose, authorization, rules and techniques to be utilized for the control of hazardous energy including the follow items: -Specific procedural steps for shutting down, isolating, locking, and securing the electrical energy sources for each kettle (per 1910.147 (c)(4)(ii)(B), -Specific requirements for testing the press to determine and verify the effectiveness of the lockout, tagout, or other energy control measure placed on the press (per 1910.147 (c)(4)(ii)(D)).
