29 CFR 1910.29(f)(1)(iii)(A): For stair rail systems installed before January 17, 2017, the employer did not ensure that the top rail of a stair rail system serves as a handrail only when the height of the stair rail system is not less than 36 inches (91 cm) and not more than 38 inches (97 cm) as measured at the leading edge of the stair tread to the top surface of the top rail: On and before November 15, 2024, a handrail with a height of 36-38 inches above the leading edge of the stair tread was not provided on the stairway between the second and third levels in the Cook Area. The stairway was equipped with stair rails with approximate height 51.75-inches, but a suitable handrail was not provided.
