29 CFR 1910.107(g)(2): All spraying areas were not kept as free from the accumulation of deposits of combustible residues as practical, with cleaning conducted daily if necessary: At the commercial facility located at 106 W 31st Street in Independence Missouri 64055: On or about February 15, 2024, and thereafter: Employees working at the facility were exposed to fires and burns, when performing spray-painting operations in areas where accumulation of spraying residue, was found in the ventilation filters that had not been cleaned or maintained after each application.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: At the commercial facility located at 106 W 31st Street in Independence Missouri 64055: Employees are exposed to increased respiratory load, as well as skin conditions including but not limited to dermatitis resulting from using tight-fitting elastomeric respirators. This was most recently demonstrated on or about February 15, 2024, and at times prior, where employees were wearing a 3M half-face tight-fitting elastomeric respirator with organic vapor cartridges while they perform spray painting operations as part of their daily duties. The employer did not develop or implement a written respiratory protection program to cover respirator use by employees.

29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program that included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): At the commercial facility located at 106 W 31st Street in Independence Missouri 64055: Employees working in the shop and spray-painting areas are exposed to hazardous fumes, dust, mists, as well as fires from the accumulation of flammable or combustible materials when performing welding, grinding, sanding and spray-painting operations during the refurbishing of steel metal containers. This was most recently demonstrated on or about February 15, 2024, and at times prior, the employer had not developed or implemented a written hazard communication program to train employees in the safety and health hazards, precautions, emergency response and safety data sheet information for all the chemicals and processes used in the workplace.
