29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: (a) Recreational Equipment Inc. 303 Lafayette Street New York, NY 10012- Bike/Ski Shop Employees are required to use P-Tex and metal grip to conduct bike and ski repairs. The employer provided Moldex N95 2300 Series (Size M/L) particulate respirators, Honeywell 7700-30L (P/N 7700-11L) (Size Large), and 3M Half Facepiece Series 6200 (Size medium) tight fitting respirators for voluntary use. The employer failed to provide employees with information contained in Appendix D. Condition observed on or about February 16, 2024 NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19

29 CFR 1910.134(c)(2)(ii):The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: (a) Recreational Equipment Inc. 303 Lafayette Street New York, NY 10012- Bike/Ski Shop Employees are required to use P-text and metal grip to conduct bike and ski repairs. The employer provided Honeywell 7700-30L (P/N 7700-11L) (Size Large), and 3M Half Facepiece Series 6200 (Size medium) tight fitting respirators for voluntary use. The employer did not provide medical evaluations by a physician or licensed health care professional (PLHCP) to qualify employees to wear respirators. Employees are exposed to chemicals such as Acetic Acid, Limonene and Aryclic Acid. The employer failed to maintain safety data sheets for all hazardous chemicals used in the facility such as but not limited to the following: P-Tex and Metal Grip. Condition observed on or about February 16, 2024 NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19
