29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: A) On or about February 29, 2024, in the machine room at Accurate Converter Recycling LLC on 133 Maple Street Suite 2, Stoughton, MA 02072, an employee was exposed to an 8-hour time weighted average noise level of 96.7 dBA (equivalently a dose of 253 %) in excess of the 85 dBA (equivalently a dose of 50%) while operating the catalytic converter cutting machine where a hearing conservation program had not been implemented. B)On or about February 29, 2024, in the machine room at Accurate Converter Recycling LLC on 133 Maple Street Suite 2, Stoughton, MA 02072, an employee was exposed to an 8-hour time weighted average noise level of 95.7 dBA (equivalently a dose of 221.6 %) in excess of the 85 dBA (equivalently a dose of 50%) while operating the catalytic converter cutting machine where a hearing conservation program had not been implemented. C) On or about February 29, 2024, in the machine room at Accurate Converter Recycling LLC on 133 Maple Street Suite 2, Stoughton, MA 02072, an employee was exposed to an 8-hour time weighted average noise level of 95.6 dBA (equivalently a dose of 216.5 %) in excess of the 85 dBA (equivalently a dose of 50%) while operating the catalytic converter cutting machine where a hearing conservation program had not been implemented. D) On or about February 29, 2024, in the machine room at Accurate Converter Recycling LLC on 133 Maple Street Suite 2, Stoughton, MA 02072, an employee was exposed to an 8-hour time weighted average noise level of 95.9 dBA (equivalently a dose of 225.8 %) in excess of the 85 dBA (equivalently a dose of 50%) while operating the catalytic converter cutting machine where a hearing conservation program had not been implemented. The hearing conservation shall include monitoring, offering hearing, baseline & annual audiometric testing, noise training, and posting of standard 29 CFR 1910.95.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: On or about February 16, 2024, in the machine room at Accurate Converter Recycling LLC on 133 Maple Street Suite 2, Stoughton, MA 02072, employees were required to wear 3M Powered Air Purifying Respirators where employer did not establish or implement a written respiratory program that included: (ii) Medical evaluations of employees required to use respirators, (v) Procedures and schedules for cleaning, disinfecting, storing, inspecting, repairing, discarding, and otherwise maintaining respirators, and (ix) Procedures for regularly evaluating the effectiveness of the program.
