29 CFR 1926.451(e)(1): Safe access was not provided to scaffold platforms when the platforms were more than 2 feet above or below the point of access:  Instance A) On or about February 20, 2024, employees were exposed to a fall hazard of approximately 17 feet when accessing a ladder jack scaffold platform along the southwest portion of the roof.  Instance B) On or about February 20, 2024, employees were exposed to a fall hazard of approximately 19.5 feet while accessing a ladder jack scaffold platform along the northwest area of the roof.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment were not independent of any anchorage being used to support or suspend platforms and/or were not capable of supporting at least 5,000 pounds (22.2 kN) per employee:  a)  On or about February 20, 2024, anchorages being used for attachment of personal fall arrest equipment were not installed so that they would be capable of supporting at least 5,000 pounds per employee attached.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level:  a)  On or about February 20, 2024, an employee performing roofing work from a pitched roof were exposed to the hazard of free falling more than 6 feet and contacting lower level areas while using personal fall arrest systems that were not rigged to prevent these hazards.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  On or about February 20, 2024, employees were exposed to fall hazards while working without fall protection from a pitched roof having a ground to eave height of approximately 19.6 feet.  JC Empire Roofing, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926. 501(b)(13) which was contained in OSHA inspection number 1581197, citation number 1, item number 1b, and was affirmed as a final order on April 22, 2022, with respect to a workplace located at 980 Bluff Ave, Glencoe, IL 60022.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
